To assume the future will happen, the new BC family law legislation is due to come into force 18 March 2013. The new BC family law is called the FAMILY LAW ACT ("FLA") and will replace the Family Relations Act ("FRA") which we have had for decades.
This change to our Provincial family law is significant for several reasons including the fact that it is the first major legislative change in decades and, like anything new, it is not certain how the new legislation will be interpreted by the courts.
The new FLA incorporates the changes in social views over the decades including the division of assets will likely be the same for common law couples as well as married couples - no longer will common law couples have to make a trust claim.
It appears that the new FLA will apply to all situations including cases in progress when it comes into effect. Of course, it will be interesting to see what happens in a trial which is in progress when the FLA comes into effect.
